Employment Law: New Notice Posting Requirements for Employers

The National Labor Relations Board has issued a Final Rule requiring most private sector employers to notify employees of their rights under the National Labor Relations Act by posting a notice.  The deadline for posting this notice takes effect 75 days after the Final Rule is published in the Federal Register.  It is anticipated that the deadline for compliance will be November 14, 2011

The notice must be printed on 11x17 paper.  The notice can be downloaded from the Board’s website.  Please be advised that employers must also post the notice on their intranet or internet site, if the employee’s personnel rules and policies are customary posted on such site. 

This requirement applies to both union and non-union work places. 

Failing to post the notice will be treated as an unfair labor practice under the National Labor Relations Act.  Failing to post could also result in an extension of the statute of limitations for employees to file their charges under the National Labor Relations Act.  Lastly, it also could be used as evidence of unlawful motive if the employer knowingly and willfully fails to post the notice.
